The DOJ documented pressure from city officials on city judges to continually increase the flow of money. This pressure to raise revenue led to practices such as tacking abusive and potentially illegal fees onto fines for minor infractions, and using arrest warrants and drivers license suspensions primarily as tools to compel payment of fines rather than to protect the public or mete out justice. Ferguson has allowed its focus on revenue generation to fundamentally compromise the role of Fergusons municipal court, the Justice Department concluded in its final report, issued in March 2015. The municipal court does not act as a neutral arbiter of the law or a check on unlawful police conduct. Its not always clear what is allowed and what is inappropriate in conversations between municipal judges and other city officials. Clearly, city council members should not tell judges how to rule on cases, according to interviews with judges and other city officials. But presiding municipal court judges also have administrative responsibilities over budgets and personnel, just like other city department heads.
